Secession was based on the idea of state rights (or "states rights," a variant that came into use after the Civil War). This exalted the powers of the individual states as opposed to those of the Federal government. It generally rested on the theory of state sovereignty-- that in the United States the ultimate source of political authority lay in the separate states. Associated with the principle of state rights was a sense of state loyalty that could prevail over a feeling of national patriotism. Before the war, the principle found expression in different ways at different times, in the North as well as in the South. During the war it reappeared in the Confederacy.
 The joint lawsuit led by Florida and now grouping 18 states was filed on March 23 by mostly Republican attorney generals............

Across our nation State Legislators are introducing and passing States' Rights bills. These bills are designed to reaffirm the 9th & 10th amendment to the Constitution. In addition to the United States Constitution each State has its own Constitution. These State Constitutions claim the same State Sovereignty that is express in the Constitution of the United States..........

States' rights are a constitutional, not political, issue, and the idea of a balance of power between the federal and state governments is neither conservative nor liberal at heart. It pertains to the theoretical process and function of government, not to the substantive, individual acts of governance themselves...........
